1. Acceptance of Terms
By downloading, installing, or using Eattie ("the App"), you agree to be bound by these Terms of Service ("Terms"). These Terms constitute a legal agreement between you and Eattie ("we," "us," or "our").
2. Description of Service
Eattie is an AI-powered nutrition coaching application that provides:
- Personalized nutrition guidance and meal suggestions
- Food logging through photos and text
- Progress tracking for health and fitness goals
- AI chat-based coaching and support
⚠️ Important Medical Disclaimer: Eattie is not a medical service. The App provides general nutrition information and guidance for educational purposes only. It is NOT a substitute for professional medical advice, diagnosis, or treatment. Always consult with a qualified healthcare provider before making significant changes to your diet, especially if you have medical conditions, food allergies, or are taking medications.
3. Account Registration
To use certain features of Eattie, you must create an account. You agree to:
- Provide accurate and complete information during registration
- Keep your login credentials secure and confidential
- Notify us immediately of any unauthorized use of your account
- Be responsible for all activities under your account
You must be at least 13 years old to create an account. If you are under 18, you must have parental consent to use the App.
4. Subscription and Payments
Free and Premium Features
Eattie offers both free and premium subscription features. Premium subscriptions provide access to additional features as described in the App.
Billing
- Subscriptions are billed through the Apple App Store
- Payment will be charged to your Apple ID account upon confirmation of purchase
- Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
- You can manage and cancel subscriptions in your App Store account settings
Refunds
Refund requests are handled by Apple according to their refund policies. We cannot process refunds directly.
5. Acceptable Use
You agree NOT to:
- Use the App for any illegal or unauthorized purpose
- Share content that is offensive, harmful, or violates others' rights
- Attempt to reverse engineer, hack, or compromise the App's security
- Use automated systems or bots to access the App
- Impersonate others or provide false information
- Interfere with or disrupt the App's operation
- Use the App to promote eating disorders or unhealthy behaviors
6. User Content
You retain ownership of content you submit (photos, messages, etc.). By submitting content, you grant us a non-exclusive, worldwide license to use, store, and process this content to provide and improve our services.
You are responsible for the content you submit and represent that you have the right to share it.
7. AI and Automated Features
Eattie uses artificial intelligence to provide nutrition guidance. You acknowledge that:
- AI-generated advice may not always be accurate or appropriate for your specific situation
- The AI learns and improves over time but has limitations
- AI responses should not replace professional medical or nutritional advice
- Food photo analysis is an estimate and may contain errors
8. Intellectual Property
The App, including its design, features, content, and technology, is owned by Eattie and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.
9. Privacy
Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms.
10. Disclaimers
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not guarantee that:
- The App will be uninterrupted or error-free
- Results from using the App will be accurate or reliable
- You will achieve specific health or fitness results
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, EATTIE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR HEALTH OUTCOMES, ARISING FROM YOUR USE OF THE APP.
Our total liability for any claims under these Terms shall not exceed the amount you paid us in the 12 months preceding the claim.
12. Indemnification
You agree to indemnify and hold harmless Eattie, its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the App or violation of these Terms.
13. Termination
We may suspend or terminate your access to the App at any time for violation of these Terms or for any other reason at our discretion. You may delete your account at any time through the App settings.
Upon termination, your right to use the App ceases immediately. Provisions that should survive termination (such as disclaimers and limitations of liability) will remain in effect.
14. Changes to Terms
We may modify these Terms at any time. We'll notify you of significant changes through the App or via email. Your continued use of the App after changes take effect constitutes acceptance of the modified Terms.
15. Governing Law
These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of California.
16. General Provisions
- Entire Agreement: These Terms, along with our Privacy Policy, constitute the entire agreement between you and Eattie.
- Severability: If any provision is found unenforceable, the remaining provisions remain in effect.
- Waiver: Our failure to enforce any right does not constitute a waiver of that right.
- Assignment: You may not assign these Terms. We may assign them to a successor or affiliate.
